Gulf Duct Industries has no material liability towards any Product other than the Product Warranty made by Gulf Duct Industries whether known or unknown, asserted or unasserted, absolute or contingent, accrued or unaccrued, liquidated or unliquidated, and due or to become due arising out of any alleged defect in the manufacture, materials used or workmanship of such Products. Gulf Duct Industries’ liability for damages, whether in contract, in tort, under warranty, in negligence or otherwise shall not exceed anything beyond the return of the purchase price paid by the buyer for such Product. To the knowledge of Gulf Duct Industries, there are no material errors in any published technical documentation or specifications of the Products and such technical documentation or specifications do not constitute a warranty of any kind (including but not limited to a warranty of merchantability or of fitness for a particular purpose), or a representation for which Gulf Duct Industries assumes any legal responsibility. The sole responsibility to assess and determine the suitability of the Product for its intended use- commercial, residential, or industrial rests with the buyer and unless expressly warranted, Gulf Duct Industries bears no responsibility in doing so. All the manufacturing standards, testing procedures, and product specifications disclosed by Gulf Duct Industries have complied in all material respects with all the requirements established by any applicable federal, state, and local laws, regulations, or governmental authority.”
